Terms & Conditions of Use

This section sets out the Terms and Conditions on which we provide the MyClubEmail.com service.

1. By clicking the "Payment" button and requesting an e-mail address from One Pixel Pty Ltd trading as My Club Email and the sports club your email address is affiliated with ("We, Us, Our"), you ("You, Your") agree and acknowledge that Your use of Our e-mail forwarding service ("the Service") is governed by the following terms and conditions.
2. We shall use reasonable endeavours to ensure that the Service remains operational, but shall have no liability to You in the event of any disruption however it is caused.
3. If you have been setup in a trial capacity, following the expiry of any said free trial period, the Service will only continue to be made available to You following receipt of the full annual cost of the Service by Us. Trial periods are limited to one e-mail forwarding address. Any additional e-mail addresses requested shall only be activated on payment of the annual subscription by You.
4. You acknowledge that the Internet is a communication medium which is subject to delays, service interruptions and other errors. Consequently, Your use of the Service shall be entirely at Your own risk.
5. You warrant that You shall at all times use the Service for lawful purposes only, and You shall indemnify Us against any claims, actions, losses, liabilities and costs arising out of Your use of the Service, including, but not limited to, use of the Service to propagate spam or other illegal or unlawful material, or for any denial of service events.
6. *CONTENT RESPONSIBILITY* You acknowledge and agree that We neither endorse the contents of any Member communications nor assume responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising therefrom or any crime facilitated thereby. Failure to do so may result in termination of your account with out recompense.
7. You warrant that You have the necessary authority to divert messages from your myclubemail.com supplied e-mail address to the diversion or forwarding addresses You provide either at the time You sign up or subsequently. You shall indemnify Us against all claims, actions, losses, liabilities and costs arising out of Your breach of this warranty.
8. We may terminate Your use of the Service (a) at any time on giving You reasonable notice; (b) immediately in the event of any breach of these terms and conditions by You.
9. We may refuse to sign You up for the Service for any reason, including, without limitation, failure by You to provide required information either accurately or at all, or the requesting of email addresses which contain words of an obscene or offensive nature.
10. You may terminate Your use of the Service at any time on giving notice to Us by sending a Notice of Cancellation to admin@myclubemail.com
11. In the event of termination under 8a, we shall refund to you the unexpired portion of Your annual fee. In the event of termination under 8(b) or 10, We shall be under no obligation to refund any unexpired portion of Your annual fee.
12. For continued use of the Service following the expiry of each annual fee, You must ensure that You renew Your use of the Service within 30 days after the expiry of the previous year's service.
13. You may update Your e-mail diversion addresses at any time during the year.
14. Our total liability to You for the provision of the Service, whether in contract, tort or otherwise shall not exceed the total sums paid by You.
15. This agreement shall be governed by the laws of the state of Victoria, Australia, and the parties hereby submit to the non-exclusive jurisdiction of the courts thereof.
